NAPOLITANO: "Anyway, there’s a clause in the Washington State constitution saying all people must be taxed the same. So you cannot have a progressive tax rate in that state."
VARNEY: "But you could have a flat tax?"
NAPOLITANO: "Yes, you could. But that’s not what this is. This taxes only certain people in certain cities at certain amounts based upon what they earn. So I think it will be invalidated."
